OVERVIEW
This website is operated by Boscova Jewellery, as a brand part of TEB CONSULTING, with office in Warszawa, at ul. Konstruktorska 7, 02-673. Throughout the site, the terms “we”, “us”, and “our” refer to TEB CONSULTING and Boscova Jewellery. TEB CONSULTING and Boscova Jewellery can be considered the same legal entity, and the terms can be interchangeable. By accessing or using our website and services, you agree to be bound by the following Terms and Conditions (“Terms”). These Terms apply to all users, including browsers, customers, merchants, and contributors of content.

Please read these Terms carefully before using our website. If you do not agree to these Terms, you may not access the website or use our services. Any new features or tools added to the current store will also be subject to these Terms. We reserve the right to update or modify these Terms by posting changes to our website. Continued use of the website after any changes constitutes your acceptance of those changes.

1.ONLINE STORE TERMS

Boscova Jewellery offers products for sale via the Boscova Jewellery website to consumer customers. By agreeing to these Terms, you represent that you are of the age of majority in your jurisdiction or have the consent of your legal guardian. You may not use our products for any illegal or unauthorized purpose, including violating copyright laws or other applicable laws in your jurisdiction. You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

In using the Boscova Jewellery website you agree to comply with Boscova Jewellery ‘s Acceptable Use Policy. By using Boscova Jewellery’s website and connecting with our social media, you agree to comply with Boscova Jewellery’s User Generated Content terms.

BEFORE PLACING AN ORDER FOR PRODUCTS YOU MUST READ AND AGREE TO BE BOUND BY THESE SALES TERMS.

YOUR ATTENTION IS DRAWN IN PARTICULAR TO THE PROVISIONS OF LIABILITY. IF YOU FIND YOURSELF UNABLE TO AGREE TO THESE SALES TERMS YOU MAY NOT PROCEED TO PURCHASE ANY PRODUCTS LISTED ON THE Boscova Jewellery WEBSITE.

2.REFUSAL OF SERVICE
We reserve the right to refuse service to anyone for any reason at any time. This includes situations where we believe an order may not be genuine, violates any law or our policies, or otherwise poses a risk. We are not obligated to provide an explanation for any refusal of service.

3.GENERAL SALES TERMS
3.1. Placing an Order
To be able to buy Products you must:
• read and accept these Sales Terms;
• provide your name and address, phone number, email address, payment details and other required information;
• provide an eligible delivery address in Europe(see below for further details);
• be legally capable of entering into binding contracts; and
• be the owner or authorised holder of a valid debit/credit card, gift card or Apple Pay account (point 6 (Payment) for details of the payment methods accepted on the Boscova Jewellery website).

You may place an order by clicking on the “ADD TO BAG” button and proceeding to the checkout page. At the checkout page you will be provided with an opportunity to review your order(s), read and accept these Sales Terms, check the total price of your order(s) and the information you have provided, and correct any input errors before confirming your order(s).
You must check and ensure that your delivery address is correct before placing your order as it may not be possible to change your address before the order is dispatched. Please see point 3.3 (Order Confirmation & Processing) below which deals with this in more detail.

You may place an order through our website by following the checkout process. You will be required to provide accurate and complete information, including your name, address, payment details, and a valid shipping address. Orders are subject to stock availability. We reserve the right to refuse service or cancel any order at our discretion for any reason, including suspected fraud or non-compliance with these Terms.

3.2. Pre-orders
Some products may be available for pre-order. Pre-order items require full payment at the time of purchase, and estimated shipping times will be provided on the product page. Pre-orders are typically shipped within 4-8 weeks, excluding holidays.

3.3. Order Confirmation & Processing
After placing an order, you will receive an email confirming your order. This email does not constitute acceptance of the order. A contract between you and Boscova Jewellery is formed when we send a shipment confirmation email. Please contact Boscova Jewellery ‘s Customer Care Team if you have not received your Shipment Confirmation within 72 hours of placing your order at hello@boscova-jewellery.com. Boscova Jewellery will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Shipment Confirmation.

If you would like to amend or cancel your order before you have received your Shipment Confirmation, you must contact the Boscova Jewellery Superheros Customer Support Team as soon as possible, or at hello@boscova-jewellery.com. Please write order number and your full name in the email.

It may not be possible to amend or cancel your order, or to prevent dispatch of the Products, due to the speed with which orders are processed. If Boscova Jewellery is unable to amend or cancel your order and the Products are dispatched to you, you have the option of either refusing to accept the delivery, in which case the Products will be returned to Boscova Jewellery, or accepting the delivery and then returning the Products to Boscova Jewellery in accordance with Return and Refund Policy.

Your order will be processed within 2-3 days for in-stock items. For made-to-order or custom-made items it may take between 4-8 weeks, depending on the product.

3.4. Shipping and Delivery
Free shipping is available for orders over 150 EUR to destination all over Europe; free shipping for USA is available for orders over 250EUR.

Delivery times are estimated as 3-5 days for in-stock items and 4-8 weeks for custom or made-to-order items. If we cannot deliver your order within the specified time, you will be notified and may cancel your order for a full refund.

3.5. Pricing and Taxes
Prices are displayed in Euro and include VAT or other applicable taxes. Shipping and handling fees are additional and will be shown during the checkout process. In the case of a pricing error, we reserve the right to correct it and notify you before proceeding with your order.

4.RETURNS AND REFUNDS
Please refer to our Return and Refund Policy (link to be added) for details on how to return or exchange products.

5.MADE-TO-ORDER AND CUSTOM JEWELLERY
For custom orders, including personalized designs or variations of existing pieces, please contact us at hello@boscova-jewellery.com. Custom orders require full payment in advance, and delivery times may vary between 4-8 weeks. Kindly note that custom orders are final sales and cannot be returned, changed, or refunded. We offer repairs for custom and made-to-order items, which can be arranged by contacting us at hello@boscova-jewellery.com.

6.PAYMENTS

Payment shall be made by one of the methods you have selected during the checkout process (being VISA, MasterCard, Maestro), via our third party supply Stripe.  

Approved credit and debit card types are listed at the Boscova Jewellery  website checkout. In the event Boscova Jewellery  does not receive the appropriate authorisation from your card or payment service provider, Boscova Jewellery  reserves the right to reject your order. 

For most payment methods, payment for your order, including all applicable taxes, shipping and other charges, will be taken from the applicable card or payment service once Boscova Jewellery has sent you the Shipment Confirmation.

 

7.WARRANTY AND REPAIRS
We offer a one-year warranty on silver products, a two-year warranty on made-to-order or custom items, and a one-year warranty on leather products for manufacturing defects. This warranty does not cover damages caused by misuse or accidental damage. For repairs on made-to-order or custom jewelry, please contact hello@boscova-jewellery.com.

8.LIMITATION OF LIABILITY
We strive to provide a high-quality service, but Boscova Jewellery makes no guarantees, representations, or warranties, either expressed or implied, that your use of the service will be uninterrupted, timely, secure, or error-free. We cannot guarantee that our website, platform, or any associated services will always function perfectly or meet your specific requirements.

We do not warrant that any results you may obtain from using the service will be accurate, reliable, or up-to-date. Furthermore, there may be instances where the service is unavailable due to technical reasons, maintenance, upgrades, or other factors beyond our control. By using our service, you acknowledge that we may, at our discretion, remove or suspend the service for indefinite periods or cancel the service entirely without prior notice to you. This may include situations where maintenance is required, unforeseen disruptions occur, or operational changes are necessary.

You expressly agree that your use of the service, or inability to use the service, is entirely at your own risk. The service, as well as all products and services offered and delivered through it, are provided on an “as is” and “as available” basis. Except as explicitly stated by us, no warranties, either express or implied, are made. This includes, but is not limited to, any implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title, merchantable quality, and non-infringement of third-party rights. We do not guarantee that any defects in the service will be corrected or that the service will meet your expectations or requirements.

8.1Liability Limitations
In no event shall Boscova Jewellery, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be held liable for any direct, indirect, incidental, punitive, special, or consequential damages of any kind. This includes, but is not limited to, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether these are based on a contract, tort (including negligence), strict liability, or any other legal theory. These damages may arise from your use of any part of the service or products obtained through the service, or any other claims related in any way to your use of the service or products, including, but not limited to, any errors, omissions, interruptions, inaccuracies, or loss of information in any content. Additionally, this applies to any losses or damages incurred as a result of your reliance on content or products made available through the service, whether posted, transmitted, or otherwise accessible.

Even if we have been advised of the possibility of such damages, we will not be liable to you for any claims exceeding the amount paid for the service or product in question, subject to applicable law. In jurisdictions where the exclusion or limitation of certain types of liability, such as consequential or incidental damages, is not allowed, our liability will be limited to the fullest extent permitted by law. This means that, in some cases, you may have additional legal rights that limit our ability to exclude or limit certain liabilities.

By using our service, you accept and agree that these limitations are reasonable in the context of the nature of the service and products offered by Boscova Jewellery, and that these limitations reflect a fair allocation of risk between you and Boscova Jewellery.

9.PERSONAL INFORMATION
Your submission of personal information through the website is governed by our Privacy Policy (link to be added). Please review this policy to understand how we collect and use your data.

9.1 Boscova Jewellery Account

To purchase from Boscova Jewellery website, you must register and create an account profile. To create your Boscova Jeweller profile, we ask you for some personal data which is outlined in our Privacy Policy.

As a member of Boscova Jewellery you are able to create, alter and share (via email or social media) a wish list, save and share your jewellery sizes, view your order history save addresses for faster checkout and be the first to receive information about new products.

If you create an account (personal user identification or username) on the Boscova Jewellery website and sign up to Boscova Jewellery, you:

  • are responsible for maintaining the confidentiality of your username and password and for restricting access to your password;
  •  agree to accept responsibility for all activities and purchases that occur under your account, unless those activities or purchases are carried out by an unauthorised third party who has gained access to your account other than by reason of your negligence or carelessness.;

You may change your password or other details in your Boscova Jewellery online profile “My Details” settings or by contacting us using the details below at any time

If you no longer wish to be a Boscova Jewellery member, you may delete your Boscova Jewellery  profile under “My account” at any time or by contacting us using the details below.

Upon your request, Boscova Jewellery will close your profile and delete your personal data as soon as reasonably possible. When your profile is closed, all your data is deleted and you will not be able to restore your profile. However, Boscova Jewellery may store and process your personal data for statistical purposes, prevention of fraud, dispute resolution and compliance purposes to the extent permitted by law. Boscova Jewellery  is entitled to delete, suspend or change your profile at any time, without notice and without prejudice, in the case of your violation or suspected violation of these Terms and/or the Terms of Use for Boscova Jewellery  website.

10.ACCURACY OF INFORMATION AND BILLING
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card details. We reserve the right to refuse or cancel any orders that appear to be placed by dealers, resellers, or distributors.

11.ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, information on our website or in the Service may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, shipping charges, transit times, and product availability. We reserve the right to correct any such errors, inaccuracies, or omissions, and to update or amend the information, or cancel orders if any information in the Service or on any related website is inaccurate, at any time without prior notice (including after you have submitted your order).

In the event of a product availability mistake, we will inform you via the email address provided with your order. You will then have the option to either cancel the order for a full refund or change your order to a different available product. If you choose to change the product, any difference in price must be paid before we proceed with fulfilling the revised order.

We are under no obligation to update, amend, or clarify any information in the Service or on any related website, including but not limited to pricing information, except as required by law. The absence of a specified update or refresh date in the Service or on any related website should not be interpreted as an indication that all the information has been updated or remains current.

12.EVENTS OUTSIDE OUR CONTROL
Boscova Jewellery is not liable for delays or failure to fulfill our obligations due to events beyond our reasonable control, including but not limited to natural disasters, war, strikes, civil unrest, pandemics, or failure of communication networks. If such an event occurs, we will notify you and take reasonable steps to minimize any delay.

13.USE OF THIRD-PARTY TOOLS
We may provide access to third-party tools, over which we have no control. These tools are provided “as is” without warranties or conditions of any kind. Any use of optional third-party tools is entirely at your discretion and risk.

14.THIRD-PARTY LINKS
Our website may include links to third-party websites that are not affiliated with us. We are not responsible for the content or accuracy of third-party websites and will not be liable for any damages arising from the use of these external sites.

15.INTELLECTUAL PROPERTY
All intellectual property rights related to the content on the Boscova Jewellery website, including designs, trademarks, and copyrights, belong to Boscova Jewellery or its licensors. Unauthorized use of any materials on the website is prohibited.

These Terms are effective until terminated by either you or us. You may terminate these Terms at any time by notifying us in writing of your decision to cease using our Services. We reserve the right to terminate these Terms immediately and without notice if, in our sole discretion, you fail or we suspect that you have failed to comply with any term or provision of these Terms of Service. In the event of termination, you will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services or any part thereof.

18.BOSCOVA JEWELLERY WEBSITE

Boscova Jewellery makes no representations or guarantees that the Boscova Jewellery website, or your Boscova Jewellery account, will always be free from errors, bugs, or viruses. While we strive to provide a secure and reliable platform, the responsibility for maintaining the security of your information technology systems, including the use of up-to-date virus protection software, lies with you. Should your account or payment details be lost, stolen, or compromised in any way, it is your responsibility to notify us immediately. In cases where we have concerns about the security of your account, we reserve the right to block access or restrict usage in order to protect your information.

When using the Boscova Jewellery website, you are strictly prohibited from engaging in any activities that might disrupt, interfere with, or negatively affect the website’s performance or security. These include, but are not limited to, the following:

These Terms and any separate agreements where we provide services will be governed by and construed in accordance with the laws of Poland.
